Terms of Service

1. Acceptance

By texting KAIA or using talktokaia.live, you agree to these Terms. If you don't agree, don't use the service.

2. What KAIA is (and isn't)

KAIA is an AI conversational companion designed for accountability, reminders, and casual chat. KAIA is not:

• a licensed therapist, doctor, lawyer, or financial advisor
• a crisis or emergency service — if you are in danger or crisis, call 911 or 988 (US Suicide & Crisis Lifeline)
• a substitute for professional medical, mental-health, legal, or financial advice

Anything KAIA says is for informational and entertainment purposes only.

3. Eligibility

You must be at least 13 years old (16 in the EU/UK) to use KAIA. By using the service you confirm you meet this requirement.

4. Messaging consent

By texting KAIA, you consent to receive automated SMS/iMessage replies, including proactive check-ins and reminders. Standard message and data rates may apply. Reply STOP to opt out at any time. Reply HELP for help.

5. Subscription & billing

• Free tier includes a limited number of messages.
• Paid plans renew automatically until cancelled.
• Cancel anytime via the manage page; access continues until the end of the current billing period.
• All sales are final unless required otherwise by law.

6. Acceptable use

Don't use KAIA to:

• break the law, harass others, or threaten anyone
• generate sexual content involving minors, violence-incitement, or hate speech
• impersonate someone else or scrape/resell KAIA's outputs
• attempt to reverse-engineer, jailbreak, or abuse the service

We may suspend or terminate accounts that violate these rules without refund.

7. Your content

You own what you send to KAIA. By using the service you grant us a license to process, store, and use your messages to provide and improve KAIA, as described in our Privacy Policy.

8. AI disclaimers

KAIA's responses are generated by AI and may be inaccurate, incomplete, or inappropriate. Do not rely on KAIA for any decision with real-world consequences (medical, legal, financial, safety). Always verify important information independently.

9. Disclaimer of warranties

KAIA is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't guarantee uninterrupted or error-free service.

10. Limitation of liability

To the maximum extent permitted by law, KAIA and its operators are not liable for any indirect, incidental, consequential, or punitive damages, or any loss of data, revenue, or profits arising from your use of the service. Our total liability is capped at the greater of (a) the amount you paid in the prior 12 months or (b) USD $50.

11. Indemnification

You agree to indemnify and hold KAIA harmless from any claims arising out of your use of the service, your content, or your violation of these Terms.

12. Termination

We may suspend or terminate your access at any time for any reason, including violation of these Terms. You may stop using KAIA at any time by replying STOP and cancelling your subscription.

13. Governing law

These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict-of-law principles. Disputes will be resolved in the state or federal courts located in Delaware.

14. Changes

We may update these Terms. Material changes will be communicated. Continued use after an update means you accept the new Terms.
